Based on information of representatives of former owner Mata Marovića, that Elementary Court in Kotor ruled in favor of inhabitants of Kotor and Tivat in dispute related to the return of the land in former farm, where company “Boka Group” build golf field, yesterday's verdict interpreted differently .
From “Bokaprodukt” stated that tdecision can not stop building of golf field, while representative of citizens Mato Marovic said that land should be returned to its former owners.
Denying other allegations, judge Srdjan Klikovac, who leads the proceeding, said that conviction is partial, which the claim refuse as unfounded.
By explaining decision, judge Klikovac repited that request of prosecutors is refused, related toall cadastral parcels, which are listed at beginning.

“To avoid any ambiguity and doubt, whether claimis is rejected or not, I made decision on the correction today apropos amendment, which clarifies rendered verdict,” said Klikovac, stating that, after appeals on hearing, as it is expected that case by appeal direct to second instance, the High Court, “the process will continue in relation to other real estate and of course there will make appropriate decisions.”
Also president of Board of Directors of “Bokaprodukt Montepranzo” Andrew Radman said that court rejected the request of the citizens, although that process, as he emhasyze, does not slow down investment and design of golf field in the area of the former farm.
He stated that building will continue as planned.
“The process is still under first instance decision because prosecutors have right to appeal, which will decide appellate authority. And after final validity, judgment is permitted for legal use,” Radman explained.
Representative of citizens Mato Marovic is satisfied with court decision and disclaims any subsequent interpretations.
“How can it be differently interpreted if the court in its decision stated ownership of land, as well as their representatives which indicated 29. Land which is not put to use should return to former owners. Any other interpretation is maliciously or corruptly. It is rovided by Law on Restitution and Compensation, ” Marovic said.
He pointed out that corruption is not missing “because all what they did with John Kennedy, all contracts, in my opinion, are illegal and unconstitutional” Marovic repited that, despite court ban and without building permit, Boka Group began construction of golf feild, but, as he said, “from the archives of Kotor court all documentation about the case has gone.”
Property owners in Tivat field reclaim about 270,000 square meters of ekspropirisanih from 1959. up to 1962. for purposes of establishing the farm, and company “Boka Group” announced that construction of golf field on over 786,000 square meters of leased land.
